Welcome to NeutralQuayStation ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and the website found at neutralquaystation.sbs (the "Service"), operated by NeutralQuayStation.
Your commitment to these Terms is required for charter booking or Service utilization. Should you object to any section of these terms, the Service will not be available to you.
2. Service Overview
NeutralQuayStation offers a range of premium yacht charter services, which include, but are not limited to:
- Yacht rentals for the day
- Evening sailing excursions
- Business retreat offerings
- Social gatherings
- Charters extending over multiple days
Our services are contingent upon availability and prior weather conditions. We may, without notice, alter or cease services.
3. Booking and Reservations
3.1 Booking Process
Charter reservation protocols include:
- Verifying that you are 18 years old or more
- Submitting valid and thorough details
- Fulfilling the deposit payment indicated in your booking confirmation
- Concurring with these Terms & Conditions
3.2 Confirmation
Confirmation of your reservation is established once your payment is received and we send out an affirmative written notice. We retain the sole discretion to decline service to any person.
3.3 Availability
All charters are contingent on the availability of the vessel and favorable weather conditions. Efforts will be made to match your requested dates and times to our offerings.
4. Payment Terms
4.1 Pricing
Quoted prices are in € and incorporate all applicable taxes except where otherwise indicated. Prices are subject to change without prior notice.
4.2 Payment Schedule
- Deposit: A requisite of half the total cost of the charter due upon booking
- Balance: Expected to be paid in full 48 hours before the charter's scheduled departure
- Additional costs (if any): To be paid when the charter concludes
4.3 Payment Methods
We can process payments via major credit cards, direct bank transfers, and verified cheques. All transactions utilize secure and encrypted processing systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Cancellation over 72 hours before departure: Full return minus transaction fees
- Cancellation between 24-72 hours before departure: Reimbursement of 50%
- Cancellation less than 24 hours before departure: No repayment offered
5.2 Weather Cancellations
Should our captain consider weather conditions unsafe, options include:
- Rebooking the charter for a new date with no extra charge
- Issuing a full repayment in cases where rescheduling isn't feasible
5.3 Mechanical Faults
If mechanical issues occur with the designated vessel, we aim to propose an appropriate alternative. In the absence of an alternative, a full repayment will be extended.
6. Safety and Conduct
6.1 Safety Demands
All guests are expected to:
- Adhere to the crew's guidance
- Utilize any provided safety gear when necessary
- Disclose any health conditions that might impact their security
- Keep to the parts of the vessel assigned for passenger access
6.2 Forbidden Items
Prohibition of items includes:
- Containers made of glass
- Prohibited substances
- Arms or any form of weapon
- Non-approved animals (exceptions made for pre-approved cases)
6.3 Behavior
Travelers are expected to behave respectfully. Should passenger conduct compromise safety or disturb the excursion for others, the charter may be terminated prematurely without a refund.
7. Liability and Insurance
7.1 Our Responsibility
We limit our liable amount to the total paid for the charter and are not accountable for:
- Injuries incurred through the negligence of the passenger
- Loss or damage to personal belongings
- Indirect, consequential, or punitive losses
- Delays due to weather or other factors beyond our control
7.2 Insurance Provisions
Comprehensive marine insurance is upheld by us, covering our fleet and operational activities. Individual travel and personal insurance is the responsibility of each passenger.
7.3 Risk Acknowledgment
In engaging with our charter services, you recognize the innate risks of marine-based activities and accept personal accountability for your safety and welfare.
8. Adjustments and Itinerary Variations
We reserve the capability to make adjustments to itineraries, pathways, or schedules based on meteorological conditions, safety requirements, or for operational reasons. Comparable experiences will be attempted to be provided.
9. Force Majeure
Obligations impeded by forces beyond our governance, including, but not confined to, are not our responsibility:
- Harsh meteorological situations
- Calamities of nature
- Laws and mandates of the government
- Shutdowns of ports
- Technical failures
10. Confidentiality and Data Preservation
Your personal data is managed as conveyed in our Privacy Policy. Your use of our service signifies consent to the data practices described therein.
11. Proprietary Rights
Copyrighted and trademarked content on our website, such as text, imagery, emblems, and photographs, must not be copied, disseminated, or reconstructed without explicit authorization from us.
12. Legal Regulation
The governing laws of Monaco dictate these Terms. Any variances will be addressed within the judicial forums of Monaco, Monaco.
13. Alteration of Terms
